The problem of formation of professional communicative
competence is especially acute in the organization of training non philological
profile, in particular the future lawyers and economists, for which successful
communication is a key indicator of professionalism.
In the legal
sphere of professional communication stands out as the most important component
of the activities of a lawyer, which determines the overall level of
professional competence and directly affect the effectiveness of the solution
of professional problems.
The specificity of the language of lawyers caused a broad
spectrum of social and cultural rights and the functioning of the social
functions of language law as an instrument of social control transmission
destination information. On the one hand, the language of rights serves
communication in the field of administrative law, in strictly legal
professional environment, on the other-due to the fact that the legal
relationship permeates the whole of society and relate to almost everyone,
written legal texts can serve as the message and impact various fields of
communication and media.
All this
requires not only a clear knowledge of the law, but also a high level of
linguistic competence. Any legal document should be competent in the legal and
linguistic aspects.
This is the synthesis of law and norms of language makes it
clear there is a legal issue, ensures the effectiveness of investigative and
judicial actions.
Thus, the training
of lawyers require special skills of verbal communication in speech and writing:
the ability to ask questions, to substantiate and adequately formulate
solutions in normative and legal practice, accurately interpret the meaning of
verbal messages that contain a particular legal information, to speak publicly
in a strictly regulated social communication situations adequately translate
the spoken word in a written statement, apply special knowledge about the word
in order to complete most of the psychological study of personality,
motivational sphere behavior.
On the basis of this speech to
a lawyer increased demands as the main instrument of professional activities,
such as:
• Regulatory, clarity, accessibility
meaning of the utterance;
• Sequence, logical
presentation of harmony, persuasiveness, legal validity;
• Compliance with the moral
and ethical rules and norms of behavior;
• Wide range of stylistic
means of expression and action.
This
is an important indicator of a high level of professional communicative
competence of lawyers who under multilingualism updated separately.
However,
practice shows that the level of language training many lawyers does not meet modern
requirements in the activities of the various legal bodies. Reduced speech
culture clogging speech foreign language, colloquial, slang, swearing and other
profanity, marked weakening of public attention to compliance in speech and
writing mandatory rules of literary language - these are processes that are
typical for the whole range of today's language functioning, including in law.
In multilingualism environment exacerbated these processes
and globalizing.
The main reason for such a difficult
situation in the sphere of legal speech culture is, in our opinion, a serious
conflict arose between the increasing needs for expertise, professional legal
fluent speech, and lack of suitable didactic system of formation, development
and revitalization of professional communicative competence of future lawyers.
Attracting
the attention of a future lawyer to wealth and stylistic diversity of the
Kazakh language, education decent relationship to any language as the main
means of communication, the degree of ownership which depends the success of
his future endeavors.
Exploring issues of forming speech culture
has a long history (Mikhail Lomonosov, F.I.Buslaev, A.M.Peshkovsky,
A.A.Shahmatov, L.V.Scherba, V.Vinogradov, G.O.Vinokur, M.V.Panov, V.G.Kostomarov,
B.N.Golovin, Yu.D.Apresyan, etc.).
Investigated the problem of formation of
professional speech culture scholars such as V.F.Aitov, S.N.Biryukova,
O.Ya.Goyhtman, I.V.Sheshneva, L.A.Konstantinova, L.N.Gorobets, N.F.Gorbunova,
S.N.Biryukova, S.V.Znamenskaya, S.N.Bazorov, E.G.Vyushkina, N.N.Ivakina,
V.P.Ivbule, T.V.Mazur, N.N.Teslikova, G.G.Chanysheva, etc.
Meanwhile, the content of teaching speech
culture, model and technology of linguistic competence, methodical provision of
training courses in modern pedagogical and methodological literature remain
relevant problems in the preparation of future specialist’s legal profile.
In addition, the formation of communicative
competence as a component of training in terms of the future lawyer multilingualism environment of high school is the problem, rather topical
and practically undeveloped. When learning a language in multilingualism environment consciousness laid student understanding of two
(or more) language systems, whereby the elements of a system are often left
over in another language. This causes a deviation from the norm and the
language lead to errors in all interference levels. Therefore, the methods and
techniques of elimination interferential phenomena in speech learning should be
an integral part of the formation of speech technology culture.
Problems
of formation of professional communicative competence of students in the
Russian-speaking audience training non philological profile within the
educational standard of higher school is determined by the fact that during the
preparation of a particular specialist pronounced costs of vocational education,
the inconsistency of its subsystems, the discrepancy between the social order
(competency approach) and universities to its unprepared ness implementation:
not revealed the content of the communicative competence of students training
non philological profile all students for law enrolled in multilingualism environment, in particular, no system for training speech
training system disciplines, which would form an elite type of speech culture
of law students.
In
this regard, clearly outlined the need to search for new organizational and
pedagogical forms and the most efficient way to ensure achievement of learning
goals in the Russian-speaking audience of training future lawyer’s state
language enrolled in multilingualism environment.
Require the integration of academic
experience with innovative teaching methods to create a model of the formation
of the communicative competence in continuing professional education. Requires
new technologies to practically implement this model to the extent that is
provided relevant plans and programs philological faculties.
Thus,
it is necessary to improve the quality of communication training for law
students in multilingualism conditions, and thus create an
effective model for teaching the state language and culture of speech in which
linguistic and speech phenomena are determined multilingualism situation and specific professional communicative roles.
