International Legal Regulation of Relations in the sphere of Information

At the end of 20th and the beginning of 21st century Information and Communication Technologies (ICT) had significant influence on the development of international relations. Their distribution is related to another stage of scientific and technical progress development - infocomm revolution. Infocommunicative revolution suggests radical changes in the society, the transformation of the traditional groups of public relations, as well as the emergence of new groups (e-commerce, e-government, e-health, distance education, etc).ICT development is closely connected with objective processes in the system of international relations. ICT is one of the factors influenced on the emergence of globalization at the same it is its component and the result of globalization. A number of information systems are of global significance such as Internet, SWIFT, payment systems and etc. The system of international information relations globalization has led to their qualitative transformation and as a result the formation of a new structure of international relations information - Information Society at the universal and regional levels. Globalization in the sphere of information has found its expression primarily in the formation of a global Information Society. The information globalization has both positive and negative consequences. Its most significant result is the widespread use of ICT in international cooperation as authoritative and no authoritative  subjects. ICTs have opened up new perspectives and new opportunities for international cooperation, have established a solid information base for its development. However, ICT have exacerbated pre-existing problems (imbalances in information exchange between developed and developing countries, the necessity to control the activities of TNCs, the guaranteed right to be informed) and also have led to the emergence of new problems: cyber terrorism, computer crime, electronic commerce, intellectual property protection in the information society and etc. Today it becomes apparent that the consequences of ICT developments, changes in the system of international relations are so radical that the International Law faces the task to work out legal requirements which will be appropriate to the level of the Information Society development. It should be stated that during ITC development the first steps were taken to establish the legal framework of the Information Society. However, these steps are mainly being taken in regard to the settlement of certain issues and predominantly at the regional level. Topical issues of the Information Society are primarily being discussed within institutional structures. International treaties in the sphere of information cover limited range of issues and do not meet the needs of the Information Society. Taking into account the mentioned above it is timely to the International Law doctrine to develop the concept of the legal regulation of international information relations in the Information Society, to analyze previous achievements and to identify the ways of developing new international legal regulations. In the 21st century Russian scientists have focused their attention on specific legal issues of international information exchange, while the objective processes in this area such as the unification, harmonization, the development of systemic formations have not found a theoretical understanding but currently a new trend towards the expansion of ITU and regional telecommunication organizations is visible. International information relations include creating, searching, receiving, distributing, transmission, using, keeping, conversing, systematizing, destructing of information, and also information access; relations of international information exchange; relations dealing with the use of telecommunications; relations concerning the implementation of international information security. Participants of these relations are states, intergovernmental organizations, international non-governmental organizations (INGOs), transnational corporations (TNCs), legal entities and individuals, administrative - territorial formations of states, subjects of federations and municipalities. Information relations become international while cross-border data transfer, the international exchange of publications, finding means of expressing information abroad. In the information field the globalization is going on to the formation of Global Information Society. Global Information Society can be defined as the system of international relations relating to the operation of information systems, which is formed on the basis of information and communication technologies developments and international information relations influence on the political, economic, social, cultural and legal relations. We agree with the V.P. Talimunchik about the necessity of the international mechanism to coordinate cooperation among states in order to form the legal basis of Global Information Society. So, we offer on the basis of the World Summit on the Information Society to create an international organization. Within the framework of the World Summit Commission on the approximation (unification and harmonization) of the norms of the Information Law can be formed. In addition, the created international organization may make an agreements with the UN, UNESCO, ITU and other international organizations to coordinate the cooperation of international organizations in order to create a legal foundation for the Information Society.
