Social and legal aspects of the media
Today
humanity lives in an age of high-tech information . Information, education and
public awareness becomes everyday, almost commonness.
One of the
functions of the government – is the function of controlling social processes,
taking place in society, as well as preventing of external controlling . Such a tool, in addition to educational
standards, adopted in the society, is the media. It has a linking function
between society and the government.
Due to
the fact that in large communities, states a huge amount of heterogeneous data
circulates, the arose question about the sample of certain information , which
is important for society at the moment. The importance of information is
determined by the concept of the development of society, its goals and ways of
achieving them. In other words, to provide control action on the social
processes in society, through the creation of images and ideas, are primary to
human activities . Originally image and idea are formed, and only then they are
implemented in practice ( if these images and ideas morally acceptable).
According
to Article 1 of the Law of the Republic of Kazakhstan "On mass media"
, the mass media - is the periodical , television , radio , documentaries ,
audiovisual recording and other form of periodic or continuous distribution to
the public media, including Internet resources .
Today, the media , as the people’s the "fourth
branch of government " gives rise to a world of information . People every
day gets a lot of new information, sometimes without even thinking about its
source - TV, radio, printed materials , advertising, the Internet - all is the
source of any information have an impact on every person's choice - from what
yogurt to eat for breakfast , and the last - presidential election .
If we talk
about the role of media in modern life, there should be a special mention about
it’s constant influence. Newspapers, magazines and news impose sad events of
our time, telling about fires, murders and frauds, at the same time actively
offering lighter tabloids, glossy magazines or entertainment programs, which
gradually fill the airwaves of radio and television. Involuntarily
contemporaries come to the conclusion, why we should read and listen to complex
information when there are funny and captivating film about "stars "
of show business or about ordinary people. Currently, the role of the media as
a source of information is particularly important. But in view of the modern
trends, we often hear the article so-called " yellow press ."
It’s need
to know, that "yellow press" – is a king of editions of printed press, affordable and specialized on rumors,
sensations (often imaginary), scandals, gossip, shocking taboo subjects. The
information in such publications acts not as spiritual and practical knowledge,
but as an entertainment product.
Journalists' rights specified in Article 20 of the Law "On Mass
Media" . However , the realization of someone's rights , including a
journalist , is the fulfillment of a person entrusted to his statutory duties .
At the same time , exercising their rights as a journalist should not infringe
the rights of individuals and legal entities .And here, unfortunately ,it’s
need to deal with the fact that many journalists, to the benefit of ranking and
popularity of the company, are ready to present untrue materials of a natural
or legal person . Thus, it is necessary to highlight the problem in the
publication of false information .
Article
19 shows that "a citizen or legal person is entitled to seek a court order
refutation discrediting his honor, dignity and business reputation. If information discrediting the honor,
dignity and business reputation of the person or entity, circulated in the
media, they should be free refuted in the same mass media . But as practice
shows, the responsibility of such media in most cases ends up paying a certain
amount of the fine or implies unproven false information in this document.
In many
countries, there was a tendency for the media, being in the shadow of
"yellow press" and scandals that was forcibly closed in court order.
Today to control the flow of information, the law should provide the liability
of the media. The Law of the Republic of Kazakhstan "On mass media"
provides a point which indicates that
for the information untrue, the media may be deprived of licenses and rights to
operate on a certain date.
Thus, a
control of information on published information, subsequently helps to preserve
the honor , dignity and , most importantly, the constitutional rights of
individuals and legal entities .
