Fighting against computer crime in the field of
information technologies in condition of globalization
This article deals with the level of fighting with
crime in condition of globalization in the Republic of Kazakhstan. Cybercrime
is one of new kind of crimes in a current globalization and its problems, rate
of growth and ways of fighting are considered. Ways of fighting against crime
in the field of information and ties are also considered.
Today our life is closely linked to the information and computer technology and the Internet. People
use computers for different purposes - system and application programs,
correspondence with various emails and get online information, banking,
investment management, purchase products. On the one hand information technologies help to form the present era of the civilized
societies, on the other hand they arise threat
and danger.
Information
space and information technologies are used to isolate political situation in separate countries and is also applied for the
purposes of communities in different types of criminal groups. Nowadays with the help of computer
technology and the Internet different revolutions are organized. For example, in 2011in North African countries with the help of Twitter Revolution (twitter social network use Revolution) had been organized at the highest level of
action of resistance. [2]
Crime which is
used in computer technology (cyber-crime) - is an international important
phenomenon that introduce, develop and use modern computer technologies and
allow them direct dependent level. Thus, quick development of information
technology in the Republic of Kazakhstan which include certain measures,
problems and potential use of computer
are great threat to national security.[4] The main aim of cybercriminals is
computer system that include different methods and obtaining information.
Statistic informants consider that it is impossible to give correct information
about cybercriminals [3]. The necessity to dissolve spread information in the
Internet is the main problem. That’s
why some experts consider to refuse from opening conception and offer to
transfer to internet system. Main conception of new model is not to keep in secret all information about network consumers
and it can provide protection from hacking.
For example, since
16 March, 2012 Chinese consumers have to give personal information – address,
telephone, Id card details. Chinese
authorities inform that “anonymous information” will be danger for society and
that’s why people must be responsible for any kind of information. Chinese
Government considers that this policy keeps social stability and stops to
spread false information and materials [6]. According to
A.L.Dzigar’s point of view people and individuals who made a contribution to
the new legislation repeated Karl Marx’s words: “not society is based on the
law, vice versa law must be based on society”, it’s a phenomenon against
individual’s wish taken from general material necessity of society’s interests
and consume [1]. Crime policy is the main part of legal policy of the
state, and to develop it will be realized criminal code and criminal code of
implementation, and complex usage and interconnectivity correction. Evaluating the present state of criminal
law, in total active development had been provided. Present Criminal law is
fighting against crime, it protects people’s rights and freedom, state and
society’s rights and criminal and legal protection.[5]. The Strategy of Kazakhstan -2050 – N.A.Nazarbaev in his message especially noted the state’s
task is to give an opportunity to realize people’s business activity, in this
goal to start the next step to modernize the national legal system. Because the
legislation should protect not only national interests but also be connected to
actively developing international legal community. With this aim the President
told the necessity to reform criminal and criminal legislation. So, it was
necessary to prepare new Criminal Code to
prevent economic crime. Introduction of this new legislation is to modernize
fight against crime policy and people be able
to fight against nowadays criminal case. This criminal code had been
prepared and interpreted and had introduced with President’s confirm. Together
with it in his message the President N.A.Nazarbayev offered new type of
dialogue G-Global. It informs about computer and internet development century
and it also has many threats to information system and that’s why it’s a great
problem to fight against cyber crime. There have been discussions about fight
against cyber crime in the G-Global platform and IN system meeting specialists
from Washington, Moscow, Amsterdam, Almaty cities have been directly connected
to discuss fight against cyber crime altogether. G-Global is a discussion
platform in the Internet. All countries of the world can discuss different
problems in online regime. Integration century problems are world widely same,
so question discussed in G-Global how to fight with information crime plays the
main role. To fight with cyber crime we should divide them into several
categories:
Legislation has made a lot in this field and is making now. For
example, legislative bodies of many countries have introduced new laws against
crimes committing through cyber crime
and it will differ with its severe punishment and also there will be
individual legislation against computer crime. It gradually regulates internet
connection and international legislative acts directed to fight with cyber
crime, for example computer crimes introducing in European convention.
Legislation in the field of fighting with cyber crime especially, further
development of international legislation in doubt will help to fight with this
phenomenon.
Organization of individual countries are obliged to fight with cyber
crimes interacted
with other countries,
law enforcement bodies and special services of
international organizations. It’s
necessary to form equal international organization like Interpol to fight with
cyber crime. In connection with it the President of the Republic of Kazakhstan
Nursultan Abishevich Nazarbayev marked
“We should form special Shankhai cooperative organization body which will serve
as “Cyberpol” directed against Internet-aggression”.[7]. Some countries have
united their power in this direction but it demands to increase and deepen
cooperation. We must protect technological community from cyber crime and keep
course of direction development technology because it helps to prevent to
commit crime. To provide high technology and programs state institutions and
companies experts in computer technology sphere effective cooperation between
them will be useful. With this aim we should unify our power to combat with our
enemies and even to prevent such crimes [2]. Above mentioned three
directions are important and can achieve goals in fighting with cyber crime.
It’s necessary to note that, in new Criminal Code (from 3 July,2013) cyber
crime was considered as one with severe punishment. Although this type of crime
is innovation it causes much harm to our society. New part “law breakers in
Information and connection sphere” have been introduced to the Code (articles 205-213). As a matter of fact to track
hackers it requires supreme professional qualifications. In conclusion to research present state of information
security and its Kazakhstani level doesn't
suit to people’s, community’s and
state's needs and requirements. To provide timely, clear and available
information to State body, namely to
protect state information resources, to identify corresponding of technical
instruments requirements and develop home protection methods. To organize
information security influences negatively due to lack of specialists in this
field. We consider it’s necessary to organize further some information
instruments and other problems of technical evaluation.
