Aspects of using and management of intellectual property in Ukraine
Economic
diversity and the world is accelerating, that is why the role of intellectual
property is important. Intellectual activity is presented as information
increases the potential entities. Effective management of intellectual property
provides significant benefits of entrepreneurship to enhance the
competitiveness of products, image and reduce production costs.
It
should be noted that researchers, determining a concept "intellectual
property", have different scientific approaches because many-sided and
difficult of this concept. For the most part existent determinations expose
legal content of this concept. Generally accepted interpretation of this term
is found by to Convention, The World Organization of Intellectual Property.
The
consequences of using the information given above are to
increase the income of the enterprise, improving quality, reducing production
costs and expand markets. However, there are some problems. Management must now
work out the exact order of economic analysis as part of intangible assets.
This will increase revenue through more effective use of intellectual property.
On the
complexity of the valuation process of property affecting various factors that
are given below.
1. One
difficulty is the absence in Ukraine of a wide active market. This makes
possible a wider use of the comparative method in the evaluation of intangible
assets.
2. An
intellectual property needs to improve the development of business within
strategic planning.
According Ukrainian
statistics [1] proportion of completed scientific and technical activities as a
percentage of GDP is in rate of 1%. In Ukraine as a whole the share of firms
that introduced innovations is low. At the end of 2010 it is 11.5%. The share
of sales of innovative products in volume to industrial end 2010 is 3.8%.
The structure
of funding innovation prevail own funds of economic entities. In the study
of registered objects of industrial property companies are allocated
Zaporizhzhyan region, we found that domestic enterprises have strong potential.
This potential includes patents, utility models, industrial designs and
certificates for trademarks. Therefore, effective use of intellectual property
and scientific potential of the enterprise should be considered as the main
priority of the enterprise.
Unlike traditional evaluation sites (machinery,
equipment, real estate and others) in the evaluation of intellectual property (IP)
is determined by the value of the scope of rights to results of intellectual
labor. Thus, the object of evaluation is right for IP, and these rights are
both territorial and temporal (urgent nature) and must be valid, the right
holder can exercise them without violating the rights of third persons [2, p.
19]
Process
of identity evaluation object is complicated because of diversity IP. IP is
unique and intangible in nature. They differ in content, form and character of representation.
Therefore it is logical to predict that for each type of IP should be used specific
approach to evaluation, which would take into account the specificity and
uniqueness of this object.
Moreover,
in most countries the government encourage and support to companies involved in
high technology and other innovative company through grants, guarantees, grants
and soft loan provided by various government financial institutions and banks
that directly or indirectly recognize importance of intellectual property
assets. [3]
In
deciding on the next action, business leaders need to estimate future direct
and indirect benefits from the commercialization of IP (implementation of in-house
manufacturing, selling licenses, protection and conservation IP, the transfer IP
as collateral, the merger or acquisition of the company or their subdivisions)
. It should be noted that early detection of outdated IP will reduce the cost
of their maintenance and indirectly gives rise to a new cycle of innovation in
the enterprise.
Intellectual property
management, which is the basis of sustainable development of industrial
enterprises should be based on an integrated approach to the combination of
regional (territorial) and sectoral aspects. Thus, in our opinion, the regional
(territorial) aspect of IP should see in the implementation of measures to
intellectual property management at the defined territories, which operates a
certain set of structural units rozhlyadayemyh objects. Consideration of
economic, political and social factors specific region allow to understand the
process of IP management as a complex system.
Given the
above, it is better to say that innovation development of economy of our
country should be based primarily on the development of domestic intellectual
capital entities represented in the form of IP that have legal protection under
applicable international and national law.
