At
periods, becoming of legal consciousness prevails her methodology, presented in
the theory of right, history of the state and right. With forming of new, as a
rule, concretely-historical form of the main
imperious consciousness, which represents new substantial legal relationships as legal relationships of new
substantial subjects and objects of static right and new substantial subjects
and objects of legal consciousness at the same time, as a rule, development of
legal consciousness is closed and begins her becoming.
Mark
farther also and that at the periods of becoming of legal consciousness
philosophical-legal not works, but theory, prevail right, normatively-legal
acts and among them the most important is new Constitution of country. Last, in
turn is maintenance of norms of constitutional legal consciousness as typically
main the legal, and by maintenance of new
legal, and actually, legislative consciousness and culture which changed in
normative sense legal consciousness.
In
world ideological-view sense a legal culture continues to execute own world
ideological-view functions, properties and mechanisms of actual maintenance of
legal spirituality of certain concretely-historical legal epoch, beginning of
which we bind to beginning of development of new concretely-historical cycle of
social activity of legal consciousness and his completion, - with completion of
development of this cycle. The periods of becoming of legal consciousness after
our context present becoming of new form of main the legal consciousness as constitutionally-legal, that standard determines
becoming of other forms of legal consciousness and culture. In the mechanism of
legal regulations of public relations of norm of legal consciousness are
the norms of legal culture and norms of static right [1-2]. But at the same time with becoming of new norms of static right, at the
terms of his unnatural forming (when a static right is formed not as national,
without the dominant of national main
legal, the basic) [3-4] there can be a risk of beginning
of deformation and elimination of new them ordinary, mentally-legal quality
which was world ideological-view fixed in the initially initial system element
of legal consciousness and spirituality - legal emotion at the beginning of
period of development. The last afterwards will be it is put in basis of
future legal psychology - dominant-priority component of legal consciousness
which develops and mutates farther.
At
new static quality of right, which lines up from legal consciousness and his
norms, disappears, as a rule in a positive right for a question about quality
of right and his norms, which at the periods of becoming of legal consciousness
of it is transformed in a the branch law, as
maintenance of the branch static legislative consciousnessі, that can not coincide with natural legal
consciousness as typically national. In this connection a question can finally
disappear about quality of any legal norm, and it can happen only at the terms
of certain or complete globalizations static rights, id est when new norms of static right finally
change at a norm, positive right so-called.
