HOW
IS LEGISLATIVE CONSCIOUSNESS CREATED?
At further research of problems
of becoming and development of Ukrainian legal consciousness legitimately is
there a question: - By what Character it is possible to identify the presence
of norms of legal consciousness, initially in the period of development of not absolutely good norms and norms of legal culture,
how more high-quality, more good norms of the right and
more good norms of the right at the norms of
legal consciousness, identified, as a rule, in the norms of static right, in
the operating priority form of legal consciousness and culture? Think, that
being of norms of legal consciousness in an operating positive static right can
be defined by a modern formula there "are good laws, but they do not
work" (V.Yushchenko), that testify that ordinary, or any other succession
of Ukrainian legal consciousness works at creation of verbal norm of right by
ordinary legal consciousness (as a rule, straight or mediated deputized by the
norms of ideological, moral, or other artificial consciousness), but
malfunctions in the norms of writing right, presented in operating
normatively-legal acts. For prevailing of norms of Ukrainian ordinary legal
consciousness in the structure of modern mechanism of the legal adjusting of the bad public relations, norm of static right or not
work, or work not absolutely completely, or
quite not executed. For prevailing of norms of legal culture of norm of static
right function both standards of the most important structural elements of
mechanism of the high-quality adjusting of public relations and high-quality
functioning of succession in operating Ukrainian the
imperious consciousness and culture as primary and her secondary
subjects. Exactly constitutionally-legal consciousness executes the functions
of dominant form of the imperious consciousness,
maintenance of which is maintenance of Constitution independent Ukraine. Here,
in our context, the norms of legal culture are those high-quality norms of
positive right, which present the mechanism of the high-quality adjusting of
public relations, in him identified as typically legal, and in which prevail
not only her high-quality but also high-quality norms of legal consciousness,
id est those which do not have crisis cycle of social activity. By then the
norms of legal culture present the new high-quality norms of static right,
presented in operating normatively-legal acts, first of all, in the norms of
operating Constitution of independent Ukraine - formal succession of Ukrainian legal
consciousness. The indexes of dominants of norms of legal culture are, for
example, criminal, other sociological and statistical indexes, for example, of
diminishing to the amount and quality of crimes, or diminishing of general criminality or decline of level them public safety.
Especially important would become annual, quarter, monthly, to the week and for days monitoring
of level of criminality in the different fields of law, nationality of
criminals, their education, marital, age-old and other status with the aim of
exposure of possible potential criminals, and also level of satisfaction
beginning the state of implementation of operating legislative base, input of
obligatory mass legal universal education, from a child to the garden, first of
all, mass primary subjects of legal consciousness, which are the producers of
mass forms of legal consciousness for other her subjects. At periods becoming of legal consciousness, which take
place, as a rule, after the periods of her development, an operating static
right can acquire at terms absence of the noted higher regular monitoring, such
total, ideological mediated or structured changes, that can grow into own new
normative essence - total law which becomes maintenance of total legislative consciousness [1-4] but gradually stops
to consider by legal consciousness, her by primary subjects. On such conditions
the state becomes totalitarian, and a law replaces a right finally, at what
positive right and positive legal science exactly a law identifies a right [2].
There is
a substitution of concepts and regulator actions. On our chart of the
concretely-historical becoming and development of Ukrainian legal consciousness
of becoming of her informal, natural (ordinary norms of on the Ukrainian mentality of the structured legal
tradition as high-quality norms of legal consciousness and culture) and formal
(artificial norms of not legal, but legislative, ideological (artificially)
mediated tradition as norms of legal consciousness, culture and static right are
at the terms of indifference of secondary subjects of legal consciousness to
the questions of quality of legal norms) succession begun with forming of
verbal norms of legal consciousness. The last are afterwards visualized in
legal архетипах and artefacts of legal culture and transformed in the writing norms of
legal acts. From occurrence of first writing legal archetypes and rightrealized artificial
artefacts begins the first visual descriptions of beginning of becoming of
legal consciousness and closed her development. Such rightjudicial actions
characterize the change of external dominant, not
always one outsourcing and bases of
family legal nature (subjects, objects, objects, values and legal relationships
of the external legal and legislative field, which abut upon the internal
Ukrainian legal and legislative field) at the periods of development of legal
consciousness on a new internal dominant,
basis and internal mental sources of
specific legal nature at the periods of her becoming (subjects, objects,
objects, mentally-legal values with clearly certain nationally-legal nature
after the formula of the Ukrainian legal idiom – with
the Ukrainian basis by a component proportion), and legal relationships
of the internal of the Ukrainian legal and
legislative field, that abut upon the external foreign legal and legislative
field). Think, further researches of will
promote to the optimal study of
different properties of Ukrainian legal to consciousness.
