Diplomatic activity of the republic Kazakhstan: legal aspects

The volume of master's thesis is 82 pages.

Thesis structure. The work consists of introduction, two chapters, consisting of two sections in the first chapter, four sections in the second chapter, conclusion, and a list of sources used.

The urgency of the study. In the Master's thesis research in international jurisprudence are comprehensively analyzed the most relevant provisions of the legal regulation of the Republic of Kazakhstan, its diplomatic activities, as well as provisions relating to the implementation of responsible persons of the legal status of the diplomatic service. The thesis focuses on the legislative normative notion of the diplomatic service of the RK, reveals the content and objectives of the Foreign Service of the RK. A content analysis of the formation and development of the diplomatic service in the RK, the legal status of diplomatic missions and consulates of the Republic of Kazakhstan accredited to foreign countries, the legal status of the diplomatic service. Such analysis is given on the basis of the current legislation and is recognized by Kazakhstan law of foreign relations.

The author formulated the scientific findings, conclusions and proposals aimed at resolving the existing theory and practice of the diplomatic relations of legal status problematic issues and consular missions abroad, the status of the diplomatic service, diplomatic immunities. Kazakhstan diplomacy has done a great deal of work for the development of mutually beneficial cooperation with other countries.
The scientific novelty of the study is that it is a comprehensive treatise on the study of the legal problems of development and establishment of the diplomatic service of the Republic of Kazakhstan. 

In the theoretical material of the thesis fragments of foreign policy studies and the Foreign Service of the Republic of Kazakhstan are shown, the legal status of the diplomatic service, the legal status of foreign consulates and missions abroad, etc. The scientific novelty of the study analyzes is the current situation regarding the legal regulation of the Foreign Service Institute of the RK. The following questions were analyzed in this study:

- Regulations, both international and national law on Diplomatic Service of the RK

- Research on the theory and history of the diplomatic service of the RK, development and improvement

- Law enforcement is the Foreign Service Institute, pointing to new directions and improves them. The results, conclusions and proposals made in this dissertation can be used in the work of the Diplomatic Service of the Republic of Kazakhstan. Master's research topic is certainly a hot topic of legal science.
Subjects selected studies in this period of development of legal, political and economic relations in the international arena, given a new impetus to the in-depth study, interpretation of individual issues of the diplomatic service of the Republic of Kazakhstan.

The purpose of master's work is to study issues related to the Foreign Service Institute of the RK, the legal status of the diplomatic service, the analysis of the regulatory framework, to identify and justify the basic steps of international cooperation of the RK, and further development of the legislative process in the Foreign Service of the Republic of Kazakhstan.

To implement the objectives indicated by setting the following objectives:

- Definition and objectives of the Foreign Service of the RK.

- Consideration of the basic features and principles of the diplomatic service of the RK

- Define the content and features of the immunities and staff privileges of the diplomatic service of the RK

- To consider the legal status of the Ministry of Foreign Affairs - as the central organ of the Foreign Ministry's diplomatic service

- To examine the legal status of foreign consulates and missions of Kazakhstan abroad

- On the basis of the study to develop proposals to improve the issues of formation and development of diplomatic activities of the RK

The object of research is the social relations in the sphere of legal regulation of the diplomatic service.

The subject of research is theoretical and legal aspects of the diplomatic service, the analysis and synthesis of the formation and development of international cooperation of the Republic of Kazakhstan at the present stage. Normative legal material, developed proposals for the development and improvement of the diplomatic activities of the Republic of Kazakhstan.

Theoretical and methodological basis of research works are the largest Kazakh, Russian and Western scholars, as well as the laws of the Republic of Kazakhstan, the regulatory scope of the Diplomatic Service of the Republic of Kazakhstan. The study is based on theoretical and conceptual proposals of the President of Kazakhstan Nursultan Nazarbayev in his message "New Kazakhstan in the new world" in which he puts forward a new strategy in the field of foreign and domestic policy, defines the strategic goals and objectives of foreign policy cooperation with the international community, sets a new position in the field of bilateral relations with various countries, regions and the international community.

  Different methods have been used in the study of master's thesis. Considerable attention was paid to political science, comparative, systematic, normative value, the methods of functional knowledge. Such approach allowed analyzing the foreign policy of international cooperation of the Republic of Kazakhstan, international agreements and the competence of the functioning of diplomatic activities of the Republic of Kazakhstan.

The scientific and practical significance of the study is that the suggestions and findings can be used in research and dedicated to the problems of the goals and objectives of the diplomatic service of the RK. Kazakhstan's diplomacy is an important component of the subject and the development, and strengthening of cooperation, and partnership in the world, acting as a competitive and stable state. Materials and research findings can be useful for professionals, students of international legal relations of the RK.

Customs Union started functioning on January 1, 2010. With the creation of a single customs territory, the abolition of customs barriers between the States Parties to the Customs Union will ensure the free movement of goods. The Union will enhance the competitiveness of the economies of the three countries and increasing investment inflows. The Customs Union was aimed at restoring the destroyed industrial relations and general improvement of the economies of the countries belonging to these unions. Free trade within the Customs Union operates on the basis of bilateral agreements, with the import and export duties, tariff and nontariff restrictions were lifted, it had a positive impact on the level of trade and economic ties.

Kazakhstan is seen by the most of countries as a region that demonstrates its disability sweeping mass reforms. The reason of that is not only corruption, but also low administration managing, weak staff resources and also in the awareness of the problems that can lead to the situation in Uzbekistan. The second problem is the condition of the administration system and political elite of the Central Asia: such as not effective structure of the administration that make conflicts so that the main task is to preserve the administration itself. Unfortunately elites of the most Central Asia countries couldn’t adapt to the new conditions. Thus the preservation of the political stability in Central Asia depends on the solving the problem of their transformation to create more stable political systems. For successful and well-timed salvation of all the problems written above by Central Asia is required to accelerate the sluggish process of the paradigm changes of its civilized development from sovereignty to realization of its own modernization mode.
