SOME OF THE PROBLEMS AND PROSPECTS FOR IMPROVING THE CIVIL SERVICE SYSTEM

 

The starting point of the formation of the civil service in the Republic of Kazakhstan can be considered a Decree of the President of the Republic of Kazakhstan having the force of law "On civil service" as of December 26, 1995, which contains a list of legal acts regulating the relations in the sphere of civil service. Thus, the institution of the public service today is comprehensive and includes the rules of various branches of law: constitutional, international, administrative, labor, finance, and others.

This regulatory legal act of the civil service system was institutionalized for the first time, the basic principles of its organization.

The adoption of the new Law "On State Service" dated 23 July 1999 on the basis of which began operating a new Kazakh model of public service, it has allowed more actively and efficiently solve problems of public service.

Law drastic innovations have been introduced. Thus, the positions of civil servants were divided into political and administrative, held a clear differentiation and classification of administrative positions, whereby in the register positions of administrative civil servants included five groups (categories) - A, B, C, D and E.

The next step for the improvement of the civil service was made in July 2005, when the following changes were made to the Law "On civil service":

-  granting authority to the Agency agreed early withdrawal of disciplinary penalties for corruption offenses, and to develop proposals to improve the quality of services provided by public authorities.

It should be noted that the search for new optimal methods for constructing the public service! is a continuous process, the law on civil service introduces new! mechanisms, which should lead to a common result - the effectiveness of the public service.

Presidential Decree of June 30, 2005 № 1598 in the structure of the Agency by making the civil service disciplinary councils are created, considering the strengthening of state discipline, compliance with anti-corruption legislation and the Code of honor of civil servants of the Republic of Kazakhstan.

Practice shows that the work of the Disciplinary Board is an important institution in the system of anti-corruption policy measures taken by the State.

As a result, the majority of crimes are committed because of ignorance of the law, and, ultimately, a negative impact on public opinion and negatively affects the image of the public service.

As for the prospects of the head of state Nursultan Nazarbayev in his speech at the International scientific and practical conference "The role of public service in increasing the country's competitiveness," highlighted the main points of the construction of a new public service model:

to strengthen the state personnel policy status will be established by the National Commission, which is responsible for the development and control of the main provisions of the new staff policy;

will be strengthened by the public service role of the business of the Agency, personnel services of state bodies. These measures will help to improve the quality of the selection of candidates and the professionalization of the civil servants;

All these measures will have to bring to the public service a new impetus, capable of bringing it to a higher level of development that meets international standards, satisfying the demands of the people and serving for him.

As is well known, successful countries have formed a civil service system for decades. Historically, such an opportunity we did not. In a short span of time we were given the best international practices and national particularities to create a civil service capable of solving the most important strategic objectives. Adopted in 1999), the law on public service meets these requirements and is by far the legal basis for the establishment and reform of civil service in Kazakhstan.

During his speech at the international conference on civil service head of state also noted the need to strengthen the status of the construction of such and personnel policy to the rank of a particularly important national priority. As part of the administrative reform now our agency, together with the Presidential Administration and the Government developed the public service concept of development, which are assumed to be effective measures to further improve its institutions and personnel. The proposed concept, in particular, to improve the selection of civil servants to carry out assessment of the quality of their work on the results, to introduce new principles of remuneration and motivation, modernize government services management.

It is also planned modernization of the order of formation of personnel reserve for political, administrative and civil service. There should be the priority of political appointments to public office candidates from the reserve, as well as the responsibility of the heads of government agencies for compliance with this provision. To ensure an objective selection for the administration: the civil service should be improved competitive procedures by introducing a two-tier competition system.

In the first stage of civil service authorized body in cases will be carried out competitive selection in the reserve through a specially designed civil service test (CBC). It will, evaluates applicants based on their professional (legal knowledge, professional sphere, etc.) and personal (business skills, qualities and skills that characterize the person as an individual) characteristics. It is necessary to improve the existing system of remuneration, by orienting it towards the labor market situation, taking into account the research segment of the wages of the private sector. It must be differentiated and clearly linked to the assessment of civil servants. So, for the promotion of the most competent and professional staff is important to establish in each state body dedicated fund additional payments (bonuses, additional payments for the achievement of the results). In addition, it is necessary to develop a special system of non-monetary incentives to improve housing conditions, as well as the formation of corporate spirit and healthy competition in the public service. The concept is planned to improve the management of the infrastructure of public service personnel.

The main elements of it are the following institutions - Executive Secretary, Personnel Department and the authorized agency for civil service affairs. Currently, personnel services more focused on the performance of technical functions associated with these tasks. They are not engaged in the development of staff, which, in turn, leads to low-interest government agencies in training and professional development of civil servants.

In this regard, for more effective management of the public service will be upgraded status of personnel services. Their main functions are: analysis of staffing needs, selection of candidates for vacancies, development of individual development plans and career development, advice on the civil service, evaluation and certification of employees. For effective implementation of the tasks will require the development and adoption of the regulation on the service personnel.

In addition, the need to improve the interaction of personnel services with the competent authority of the Civil Service. Taking into account the increasing requirements to the authorized body is necessary to strengthen the status of the Republic of Kazakhstan Agency for Civil Service Affairs. And in order to implement a uniform policy in improving the quality of public services give the authorized body and its territorial divisions appropriate authority to assess and monitor the quality of public services. Implementation of these measures will require further strengthening and improving the legal framework of public service, possible amendments to the current law on civil service. However, despite the relatively short period of validity of this law, its implications for the public service of Kazakhstan can not be overestimated. It became the basis for the formation of the modern Kazakh model of public service, which played an important role in the development of Kazakhstan's statehood, political, social and economic development of the country. The value of the public service in the development of the country praised the Head of State, in one of his speeches, noting that "the results are proud, today Kazakhstan, achieved thanks to the work and civil servants" [4]. The potential of our civil service and its legal basis is high, and we need to continue to further improve, and improve their quality parameters, taking into account the increasing demands from society.
