SOME OF THE PROBLEMS AND PROSPECTS FOR IMPROVING THE
CIVIL SERVICE SYSTEM
The starting point of the
formation of the civil service in the Republic of Kazakhstan can be considered
a Decree of the President of the Republic of Kazakhstan having the force of law
"On civil service" as of December 26, 1995, which contains a list of
legal acts regulating the relations in the sphere of civil service. Thus, the
institution of the public service today is comprehensive and includes the rules
of various branches of law: constitutional, international, administrative,
labor, finance, and others.
This regulatory legal act of
the civil service system was institutionalized for the first time, the basic
principles of its organization.
The adoption of the new Law
"On State Service" dated 23 July 1999 on the basis of which began operating
a new Kazakh model of public service, it has allowed more actively and
efficiently solve problems of public service.
Law drastic innovations have
been introduced. Thus, the positions of civil servants were divided into
political and administrative, held a clear differentiation and classification
of administrative positions, whereby in the register positions of
administrative civil servants included five groups (categories) - A, B, C, D
and E.
The next step for the
improvement of the civil service was made in July 2005, when the following
changes were made to the Law "On civil service":
Institute of rotation of
political civil servants;
- granting authority to the Agency agreed early
withdrawal of disciplinary penalties for corruption offenses, and to develop
proposals to improve the quality of services provided by public authorities.
- the spread of the Institute transfer to law
enforcement;
- the possibility of a class of administrative
government positions on non-competitive basis for the judges who have stopped
their powers;
- prohibition of public servants who have unwithdrawn
disciplinary penalty for a corruption offense, to hold administrative positions
in government transfer order;
- Termination new administrative public service - the
entry into force of a judgment of conviction;
- ban on persons who have committed crimes of
corruption, to hold public office;
- exemption of civil servants who have experience of
public service at least 20 years old, from the testing procedure in passing the
certification of [1]
It should be noted that the
search for new optimal methods for constructing the public service! is a
continuous process, the law on civil service introduces new! mechanisms, which
should lead to a common result - the effectiveness of the public service.
Presidential Decree of June
30, 2005 № 1598 in the structure of the Agency by making the civil service
disciplinary councils are created, considering the strengthening of state
discipline, compliance with anti-corruption legislation and the Code of honor of
civil servants of the Republic of Kazakhstan.
Practice shows that the work
of the Disciplinary Board is an important institution in the system of
anti-corruption policy measures taken by the State.
Implementation of control
functions for compliance with the legislation on public service,
anti-corruption legislation and the Code of honor of civil servants assigned
to] the secretariats of the Disciplinary Board.
To date, a large number of
unresolved issues related to the organization of public service, a direct
impact on the efficiency of public administration, and it is, turn on the
improvement of life of Russians, continue to affect the slaves governing
structures of the Republic of Kazakhstan.
Public service, if it is
skillfully organized, there is a guarantee that any question from the strategic
to the consumer in the state apparatus will be considered by the I appropriate,
in a timely manner, in accordance with applicable legal regulations! acts
rationally and comprehensively. And this requires appropriate procedures
institutional order of cases, monitoring mechanisms, clear regulation of
records management, and more, suggest that the public service is realized HJ
based on modern information and legal technology.
One of the important
problems of public service organizations - the formation and development of
civil service personnel - it is a multidimensional and complex process, which
manifests itself in a dialectical relationship of static and dynamic. In
addition to the legal, regulatory procedural aspects of this development
involves the enrichment of many social and administrative parameters,
especially such as the growth of professionalism of employees, change their
social values, moral principles, changes in age, professional qualification!
tender structure of the personnel and other quantitative and qualitative
characteristics.
Also noteworthy is a
conceptual aspect of the problem is considered "the public service both in
terms of the object and the subject of management. And the object of legal and administrative
powers of the officials at various levels are not the same.
For the public
administration is not typical that only one doubles category "subject -
object", the subject-object relationship. The civil service people, the
machine a separate entity (department, office) are both subject to the higher
of the subject and the subject of the subordinate employees or employees under
the jurisdiction of the sphere. In various management cycles and levels of
subjects and objects are swapped. In addition, one object 'often affect several
interconnected control subjects. Therefore, the public service as a
hierarchical system of regulated activities and the management of relations, it
is necessary to clearly define the scope, the content of the functions and
powers of each entity boundaries of managed objects, the degree of
interdependence and accountability. This was one key to reforming the system
and structure of government in the course of the current administrative reform.
In addition, the activities of each person holding public office, can be aimed
at both internal object (slave workers, subordinate structure | activities) and
an external object (population downstream structures of power, under the
jurisdiction of
Also among the civil service
issues that should be implemented in the near future include:
The professionalization of
the civil service staff.
In a survey of the heads of
government agencies, only 68% of them are "satisfied" and
"generally satisfied" with the quality of work of their subordinates.
However, only 51.3% of public servants themselves satisfied with their work,
which leads to high levels of annual turnover (turnover) of 15.7%.
Social protection of civil
servants.
Only 9.6% of civil servants
are satisfied fully and 34.8% partially satisfied with the size of salary. 24%
of government employees are satisfied with career opportunities.
The introduction of new
forms of training of civil servants.
There is a low interest
government agencies in education, intellectual growth of civil servants.
Satisfaction with the opportunity to raise qualification is only 39.2%. [2]
The poor quality of public
services.
This problem is one of the
most important based on the fact that the quality of public services received
by individuals and legal entities, determines the overall quality of the work
of state bodies and the degree of public satisfaction with their work.
Compliance with the
legislation on the Civil Service and the Code of Honour.
The fight against the
manifestations of corruption, monitoring of compliance with legislation in the
sphere of public service assigned to the Disciplinary Board. In this connection
there is a question of giving more authority to the Disciplinary Board, as a
body capable of conducting aggressive policy in this area.
Despite the measures taken
by the Disciplinary Board to reduce violations of the Code of Honour and the
anti-corruption legislation, the number of offenses is not reduced, indicating
that insufficient legal and advocacy for prevention of corruption offenses and
the observance of the Code of honor on the part of leaders at all levels. Field
work for the prevention of violations often is a mere formality, no concrete
results. As a result, the majority of crimes are committed because of ignorance
of the law, and, ultimately, a negative impact on public opinion and negatively
affects the image of the public service.
As for the prospects of the
head of state Nursultan Nazarbayev in his speech at the International
scientific and practical conference "The role of public service in
increasing the country's competitiveness," highlighted the main points of
the construction of a new public service model:
to strengthen the state
personnel policy status will be established by the National Commission, which
is responsible for the development and control of the main provisions of the
new staff policy;
will be strengthened by the
public service role of the business of the Agency, personnel services of state
bodies. These measures will help to improve the quality of the selection of
candidates and the professionalization of the civil servants;
for the introduction of a
new system of training, recruitment and career development of the most talented
and trained candidates to the Agency will be set up the National Centre for
Civil Service Personnel Management;
It will clear distinction
between the political and administrative civil service;
administrative public
service of the new model will consist of two main buildings. First body-
"Building A" - a corps of professional public managers personnel who
will be engaged in the planning and implementation of specific public policies.
All other administrative state employees will become part of "Building
B".
acting pay system will
undergo major changes aimed to refuse:
- egalitarian approach. Work will be judged on the
outcomes of each, depending on the
- complexity, the market value and the personal
contribution;
- It will be abolished existing system of personnel
reserve, which has not justified itself, and, moreover, a mechanism to "bypass"
the legal procedure of appointment to public office;
- ongoing training and professional development will be
one of the main priorities of the public service.
- to improve the quality of public services of
Kazakhstan Agency for Civil Service Affairs is empowered to monitor compliance
with standards of public services;
- work will continue to address the gaps in the
legislation on civil service and anti-corruption legislation, as well as to
improve relations through cooperation with civil society organizations [3]
All these measures will have
to bring to the public service a new impetus, capable of bringing it to a
higher level of development that meets international standards, satisfying the
demands of the people and serving for him.
As is well known, successful
countries have formed a civil service system for decades. Historically, such an
opportunity we did not. In a short span of time we were given the best
international practices and national particularities to create a civil service
capable of solving the most important strategic objectives. Adopted in 1999),
the law on public service meets these requirements and is by far the legal
basis for the establishment and reform of civil service in Kazakhstan.
During his speech at the
international conference on civil service head of state also noted the need to
strengthen the status of the construction of such and personnel policy to the
rank of a particularly important national priority. As part of the
administrative reform now our agency, together with the Presidential
Administration and the Government developed the public service concept of
development, which are assumed to be effective measures to further improve its
institutions and personnel. The proposed concept, in particular, to improve the
selection of civil servants to carry out assessment of the quality of their
work on the results, to introduce new principles of remuneration and
motivation, modernize government services management.
It is also planned
modernization of the order of formation of personnel reserve for political,
administrative and civil service. There should be the priority of political
appointments to public office candidates from the reserve, as well as the
responsibility of the heads of government agencies for compliance with this provision.
To ensure an objective selection for the administration: the civil service
should be improved competitive procedures by introducing a two-tier competition
system.
In the first stage of civil
service authorized body in cases will be carried out competitive selection in
the reserve through a specially designed civil service test (CBC). It will,
evaluates applicants based on their professional (legal knowledge, professional
sphere, etc.) and personal (business skills, qualities and skills that characterize
the person as an individual) characteristics. According to the test results
will be a unified database 'data of applicants for admission to the civil
service.
In the second phase the
relevant state body through special tender procedures (essay, interview, etc.)
will make the selection of the proposed reserve, corresponding to qualification
requirements and scored the required points on the CBC, to assign a specific
administrative position. Also in the planning concept specified to improve the
system of civil service personnel by modernizing training systems and training
and gain the attention of their physical development. In continuation of
strategic and operational plans, government agencies need to implement the
annual plans of individual public servants, which will allow to select
educational programs tailored to the needs of a professional civil service and
to personalize the funds going to raise their qualifications. With regard to
reforming the system of certification and career planning of civil servants,
the improvement of their professionalism requires the implementation of
flexible and differentiated evaluation system: when entering and passing the
civil service. This assessment will be based on the measurement of labor input
and the results achieved.
civil servant's career is an
important part of public service and describes the official promotion that
provides professional and social self-realization of the civil servant in
accordance with his level of qualification main criteria for improving
administrative civil servants are: the availability of professional
qualifications, the successful implementation of individual development plan,
the positive results of the interim evaluation and certification, experience
and length of service, personal and ethical qualities. The system of motivation
and social protection of civil servants must be a direct stimulus of high
performance and deterrent highly qualified personnel in the public service, as
well as a measure to prevent the various corruption offenses. It is necessary
to improve the existing system of remuneration, by orienting it towards the
labor market situation, taking into account the research segment of the wages
of the private sector. It must be differentiated and clearly linked to the assessment
of civil servants. So, for the promotion of the most competent and professional
staff is important to establish in each state body dedicated fund additional
payments (bonuses, additional payments for the achievement of the results). In
addition, it is necessary to develop a special system of non-monetary
incentives to improve housing conditions, as well as the formation of corporate
spirit and healthy competition in the public service. The concept is planned to
improve the management of the infrastructure of public service personnel.
The main elements of it are
the following institutions - Executive Secretary, Personnel Department and the
authorized agency for civil service affairs. Currently, personnel services more
focused on the performance of technical functions associated with these tasks.
They are not engaged in the development of staff, which, in turn, leads to
low-interest government agencies in training and professional development of
civil servants.
In this regard, for more
effective management of the public service will be upgraded status of personnel
services. Their main functions are: analysis of staffing needs, selection of
candidates for vacancies, development of individual development plans and
career development, advice on the civil service, evaluation and certification
of employees. For effective implementation of the tasks will require the
development and adoption of the regulation on the service personnel.
In addition, the need to
improve the interaction of personnel services with the competent authority of
the Civil Service. Taking into account the increasing requirements to the
authorized body is necessary to strengthen the status of the Republic of
Kazakhstan Agency for Civil Service Affairs. And in order to implement a uniform
policy in improving the quality of public services give the authorized body and
its territorial divisions appropriate authority to assess and monitor the
quality of public services. Implementation of these measures will require
further strengthening and improving the legal framework of public service,
possible amendments to the current law on civil service. However, despite the
relatively short period of validity of this law, its implications for the
public service of Kazakhstan can not be overestimated. It became the basis for
the formation of the modern Kazakh model of public service, which played an
important role in the development of Kazakhstan's statehood, political, social
and economic development of the country. The value of the public service in the
development of the country praised the Head of State, in one of his speeches,
noting that "the results are proud, today Kazakhstan, achieved thanks to
the work and civil servants" [4]. The potential of our civil service and
its legal basis is high, and we need to continue to further improve, and
improve their quality parameters, taking into account the increasing demands
from society. All the conditions for that we have.
