GOING IS NEAR
STUDY OF INTERCOMMUNICATION
OF LEGAL, POLITICAL LEGAL CONSCIOUSNESS
AND CULTURE IN REALIZATION OF IDEOLOGICAL FUNCTION OF DERZHVI
During
XX age the ideologists
of most developed in the economic
relations of the states asserted that economy growing, democracy and personal happiness of every
individual, indissolubly connection between itself. The ideological function of
the state appears today
one of major in the realization, mainly, due to difficult
logic of transitional legal and political consciousness|intelligent| and, accordingly|according|, tests strong influence from the side of this forms of public sense of justice.
There is a requirement in
the study of
legal and political consciousness
in their unity and difference during realization of ideological function of the
state as typically legal.
To every state a peculiar
specific ideological function is both typically legal and as a function of country – law consciousness, which it carries|performs| out as present, and it is hidden. In the
system of ideology of the state as major component parts|portion| enter the idea of legal and political consciousness, and also complex ideas,
mechanism of their interpretation. In a positive right – maintenance positively legal (subjectively
legal) the forms of
Ukrainian sense of justice legalized setting legal, and|but| through
them and political ideology the states which set legal procedures,
imperious relations.
It is possible to select two legal models of realization of ideological
function of the state: idea and
manipulation. The first models are characterized support on the opened legal form of the use of methods of realization
the ideological function of the state, and second
– by the washed out state
ideology, with support on the hidden form of the use
of methods of realization of ideological function of the state (decrees with a
vulture «Secretly» but|yes| other). Political and legal consciousness are characteristic characteristics, and also
contain specific other
and other spring legal ideas
which is determined these
properties.
Intercommunication
of legal and political consciousness,
culture, appears in
intercommunication
of this legal ideas in the system of ideology of the state, in a positive right which represents its maintenance
as maintenance of legal consciousness,
and also in political documents
which represent elements of political ideology in proper arch – fact of Ukrainian legal consciousness|intelligent| and culture. Legal consciousness interprets ideas which is included in the system of state ideology, actually, as native, legalistically,
by their
substitution procedure.
Political consciousness
interprets this ideas richly in content
and teleological . Differences
between legal and political interpretation of elements of state ideology make the major aspect of realization
of ideological function of the state. In this aspect the ideological function
of the state presents the function of legal consciousness – function of the
normative adjusting
of reality, priority
of norms of sense of
justice above the norms of static right and country –law consciousness as a mechanism of the
legal adjusting of
public relations [1]. By
the ideological function the state determines forming of legal and political consciousness of citizens, which is
instrumental in
strengthening of the
public system of values, achievement of socially useful|benefit| aims, facilities of direct ideological
influence on citizens by active politico – law education, socialization and
forming of active legal culture.
